RESOLUTION AUTHORIZING COOPERATIVE FIRE PROTECTION AGREEMENT WITH MNDNR DIVISION OF FORESTRY FOR COOPERATIVE RESPONSE TO WILDLAND FIRE CALLS.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a cooperative fire protection agreement substantially in the form of that attached hereto as exhibit A with state of Minnesota acting by and through the commissioner of the department of natural resources for the cooperative response to wildland fires in and around the city with compensation received by the city to be paid to the general fund 110, fire 150, administration 1501, 4340 fire protection services.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the city to enter into a cooperative fire protection agreement with the MnDNR for response to wildland fires, predominantly grass fires mostly within the city and providing for compensation to the city for the response.
The fire department normally responds to grass fires in the city in the ordinary course of its work. This agreement will allow the city to receive compensation for that response. The normal compensation will be $350 per incident, with provision to request a higher level of compensation in the event of needing to deal with a more extensive conflagration. The agreement also allows the DNR to request the city to respond to a wildland fire outside of the city but leaves the response to the discretion of the city.
The agreement does contain provisions for indemnification of the DNR.
