RESOLUTION AUTHORIZING THE EXECUTION OF A PURCHASE AGREEMENT WITH THE HOUSING AND REDEVELOPMENT AUTHORITY OF DULUTH, MINNESOTA FOR THE SALE OF PROPERTY IN THE LINCOLN PARK NEIGHBORHOOD FOR NOMINAL CONSIDERATION.

CITY PROPOSAL:
WHEREAS, pursuant to Section 2-177.3 of the Duluth City Code, 1959, as amended (the "Code"), the city council is considering the sale of the following described certain real property to The Housing and Redevelopment Authority of Duluth, Minnesota (the "HRA") through Ordinance No. 25-009 (the "Property"):

East 1/2 of Lot 326, Block 109, Duluth Proper Second Division AND
West 1/2 of Lot 324, Block 109, Duluth Proper Second Division

St. Louis County, Minnesota

WHEREAS, the Property is an approximately 50' x 140' strip of land in the Lincoln Park neighborhood;
WHEREAS, the HRA owns real estate adjacent to the Property (the "HRA Property") and desires to acquire the Property to combine it with the HRA Property to facilitate the development of an affordable housing project (the "Project").
WHEREAS, pursuant to Section 11 of the Duluth City Charter, 1913, as amended ("Charter"), every ordinance, other than an emergency ordinance, shall have two public readings;
WHEREAS, pursuant to Section 15 of the Charter, most ordinances enacted by the council shall take effect 30 days after the date of their last publication ("Effective Date"); and
WHEREAS, the parties need to enter into a purchase agreement in advance of the Effective Date so the HRA may conduct due diligence on the Property and begin working with a local nonprofit corporation on the Project.
NOW, THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to enter into a purchase agreement, substantially the same as the agreement attached as Exhibit 1, with The Housing and Redevelopment Authority of Duluth, Minnesota, a public body corporate and politic under the laws of Minnesota, for the sale of the Property for $1.00, plu...
