CITY PROPOSAL:

RESOLVED, that the city council approves settlement of all claims or causes of action in a matter presently venued in the United States District Court for the District of Minnesota and identified as Green, et al. v. Ramsay, et al., Court File No. 14-cv-4856 (SRN/LIB) (D. Minn. 2014), pursuant to the terms and conditions of a Mediated Settlement Agreement substantially in the form of that attached hereto as Exhibit A.

FURTHER RESOLVED, that pursuant to the terms of the Mediated Settlement Agreement substantially in the form attached hereto, the city council hereby deems its prior July 21, 2014 revocation, pursuant to Duluth City Council Resolution 14-0382, of the on-sale intoxicating liquor license previously held by Wessman Estates, LLC ("Wessman"), and governing the premises at 501 E. 4th Street, Duluth, Minnesota, 55805 (the Twins Bar), as a voluntary surrender by Wessman of the liquor license back to the administration of the city for future grant in its normal course.

FURTHER RESOLVED, that the proper city officials shall take all actions necessary to conclude this matter on a full, final, and complete basis.

Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes city officials to implement the Mediated Settlement Agreement in Green, et al. v. Ramsay, et al., Court File No. 14-cv-4856 (SRN/LIB) (D. Minn. 2014). City approval is requested because the settlement agreement asks the city to deem its previous revocation of the on-sale intoxicating liquor license held by Wessman Estate, LLC ("Wessman"), governing the operation of the Twins Bar at 501 E. 4th Street, Duluth, Minnesota, 55805, in July 21, 2014 pursuant to City Council Resolution 14-...
