RESOLUTION AUTHORIZING A TWO-YEAR LICENSE AGREEMENT WITH STATE OF MINNESOTA, ACTING BY AND THROUGH THE COMMISSIONER OF THE DEPARTMENT OF NATURAL RESOURCES, TO UTILIZE CERTAIN CITY-OWNED PROPERTY TO PERFORM A WATERSHED STREAM RESTORATION PROJECT IN KINGSBURY CREEK.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into and execute a two-year license agreement, substantially in the form attached as Exhibit 1, with the State of Minnesota, acting by and through the Commissioner of the Department of Natural Resources, to utilize certain city-owned property in connection with a watershed stream restoration project in the Kingsbury Creek (the "Project") to perform activities related to the Project, including but not limited to vegetation and debris clearing, channel and bank grading, bank stabilization, channel realignment, and temporary stream dewatering.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the city to enter into a license agreement with the State of Minnesota, acting by and through the Commissioner of the Department of Natural Resources (the "DNR"), to utilize certain city-owned property in connection with a watershed stream restoration project in the Kingsbury Creek (the "Project") to perform activities related to the Project, including but not limited to vegetation and debris clearing, channel and bank grading, bank stabilization, channel realignment, and temporary steam dewatering. The Project will occur on certain city-owned property, as well as privately-owned property. The DNR will perform the Project at no cost to the City.
The Project will reduce erosion along Kingsbury Creek and 68th Avenue West Creek to reduce erosion and sedimentation washing downstream into Kingsbury Bay and enhance habitat for trout and associated cold-water organisms.
