Title

RESOLUTION ACCEPTING A PERMANENT EASEMENT FROM KWIK TRIP, INC., FOR PUBLIC RECREATIONAL, WALKWAY AND TRAIL PURPOSES OVER, UNDER AND ACROSS CERTAIN REAL PROPERTY IN THE IRVING NEIGHBORHOOD, AT NO COST TO THE CITY.

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from KWIK TRIP, INC., a Wisconsin corporation, a permanent easement for public recreational, walkway and trail purposes over, under and across the real property legally described and depicted on Exhibit B to the attached Exhibit 1, at no cost to the city.

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent easement for public recreational, walkway and trail purposes from KWIK TRIP, INC., a Wisconsin corporation, under, and across certain property in the Irving neighborhood, at no cost to the City.

This easement is needed in connection with an upcoming project to extend the Cross City Trail (“CCT”) at Raleigh Street for approximately 1,100 feet.  The CCT is a multi-purpose, non-motorized, paved trail that connects the Lakewalk in Canal Park to the Munger and Waterfront Trails in western Duluth.  The CCT provides a dynamic experience for users of all ages and abilities, showcasing both the industrial and natural assets of Duluth and the St. Louis River Corridor.

An aerial map depicting the approximate easement area is attached as Exhibit 2.
