RESOLUTION ACCEPTING THE CONVEYANCE OF REAL PROPERTY FROM THE STATE OF MINNESOTA FOR PUBLIC PARK, BOULEVARD AND MUNICIPAL FOREST PURPOSES.

CITY PROPOSAL:

 

                     RESOLVED, that the proper city officials are hereby authorized to accept the conveyance of that certain real property legally described in Tract Nos. 1 and 3 on the attached Exhibit A, from the state of Minnesota, for public park, boulevard and municipal forest purposes, at no cost to the city.  The state deed conveying the property is attached hereto as Exhibit B.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to accept the conveyance of certain real property located in Magney-Snively Park from the state of Minnesota for public park, boulevard, and municipal forest purposes.

 

In 1943, the state of Minnesota conveyed tax-forfeited property to the city of Duluth.  The state deed was properly recorded with the St. Louis County recorder.  However, some of the property conveyed was registered property and needed to be recorded with the St. Louis County examiner of titles.  The District Court directed the St. Louis County examiner of titles to register the property contained in the state deed, but for unknown reasons, only a portion of the registered property contained in the document was recorded.

 

The city recently discovered the title issues associated with the lack of proper recording of this state deed and would like to properly record the document.  However, this real property was not formally accepted in 1943 and the city needs to authorize the acceptance of the property contained in Tract Nos. 1 and 3 on the state deed in order to complete the recording process.
