RESOLUTION AUTHORIZING AND ACCEPTING A PERMANENT EASEMENT FOR RIGHT-OF-WAY AND UTILITY PURPOSES FROM AND WITH ST. LOUIS COUNTY, ON BEHALF OF STATE OF MINNESOTA, IN TRUST FOR THE TAXING DISTRICTS, OVER, UNDER, AND ACROSS CERTAIN REAL PROPERTY IN THE EAST HILLSIDE NEIGHBORHOOD, FOR $150.

CITY PROPOSAL:

                     RESOLVED, that the proper city officials are hereby authorized to accept and enter into an easement agreement, substantially in the form attached as Exhibit 1, from and with St. Louis County, on behalf of the State of Minnesota, in trust for the taxing districts, for a perpetual, exclusive easement for right-of-way and utility purposes over, under, and across the real property legally described and depicted on Exhibit B attached to Exhibit 1, for $150; payable from Fund 110-500-1930-2300-5441.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes and accepts an easement agreement (the “Easement”) from and with from and with St. Louis County, on behalf of the State of Minnesota, in trust for the taxing districts (the “County”), a perpetual, exclusive easement for right-of-way and utility purposes over, under, and across certain real property (the “Easement Area”) in the East Hillside neighborhood, for $150.  The Easement Area is south of the intersection of E. Skyline Parkway and 7th Ave. E.  A portion of existing E. Skyline Parkway goes through the Easement Area.  The approximate location of the Easement Area is depicted on the map attached as Exhibit 2.

 

The City and County have been negotiating an easement agreement template for a couple of years following the settlement of the Tyler v. Hennepin County lawsuit regarding tax-forfeited lands.  The Easement Area was the last easement the City and County were negotiating when the lawsuit paused all conveyances, including the granting of easements.  Now that the new easement agreement template is finalized, the County desires to move forward with this Easement first.  The parties can now move towards finalizing several other easements, all of which will be brought to City Council for approval as they are completed.

 

The acceptance of this Easement creates public rights in the Easement Area so the City can operate, maintain and repair E. Skyline Parkway and the adjacent sidewalk.
