Title

RESOLUTION AUTHORIZING A THREE-YEAR NON-EXCLUSIVE USE AGREEMENT WITH DULUTH GIRLS FASTPITCH LEAGUE FOR THE USE OF THE HELMER CARLSON FIELDS AND PIEDMONT FIELD.

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to enter into a three-year non-exclusive use agreement, substantially in the form attached as Exhibit 1, with Duluth Girls Fastpitch League for use of the Helmer Carlson Fields and Piedmont Field for its youth softball program.

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes a three-year agreement with the Duluth Girls Fastpitch League (“Girls Fastpitch”) for use of Helmer Carlson Fields and Piedmont Field (collectively, the “Fields”) for its youth softball program.  The Fields are located at 33 West Mulberry Street and 2303 West 23rd Street.  Girls Fastpitch may use the Fields between May 1 and July 31 during each year of this agreement on a non-exclusive basis.  However, Girls Fastpitch shall have exclusive use of the Fields on certain days and times as indicated in the agreement.

There is no usage fee associated with this agreement because Girls Fastpitch uses the Fields on a non-exclusive basis and performs general ball field and lawn care maintenance duties, including but not limited to raking, mowing, trimming, fertilizing, and watering.  Girls Fastpitch is also responsible to prepare the Fields for its practices and games, which duties include infield dragging, chalking, and ag-lime application.  In addition, Girls Fastpitch is responsible to maintain the Fields in a clean and orderly condition and shall pick up all paper, garbage, and other debris generated from its use.
