RESOLUTION ACCEPTING A TEMPORARY EASEMENT FOR CONSTRUCTION PURPOSES AT KENWOOD AVENUE AND ARROWHEAD ROAD FROM INFINITY MANAGEMENT, INC.

 

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept a temporary easement for construction purposes as described in the Temporary Easement Agreement attached as Exhibit A from Infinity Management, Inc., a Minnesota corporation, over that portion of Lot 10, Block 4, KENWOOD PARK ADDITION TO DULUTH, described below:

 

                     All that part of Lot Ten (10), Block Four (4), KENWOOD PARK ADDITION TO                      DULUTH, City of Duluth, St. Louis County, Minnesota lying between two lines                      0.00 feet and 5.00 feet southeasterly of the following described Line "A":

 

                                          LINE "A"

 

                                          Commencing at the northwest corner of said Lot 10, thence easterly along                                           the north line of said Lot 10, a distance of 19.50 feet to the Point of                                                                                     Beginning of the line to be described; thence southwesterly to a point on                                                                the west line of said Lot 10, distant 15.50 feet southerly of said northwest                                                                corner and said line there terminating.

 

Subject to the reservation to the Property of the right to maintain, repair, operate and reconstruct a pylon sign having a maximum height of 15 feet and a base of not more than 3 feet by 3 feet in size at its current location as shown on Attachment 1 referenced below, including electrical and communications infrastructure necessary to serve said sign, but which sign shall otherwise comply with all then-existing laws, ordinances, rules and regulations applicable thereto including in any nonconforming status.

 

Said temporary easement is depicted on Attachment 1.

 

Said easement shall terminate no later than December 31, 2016.

STATEMENT OF PURPOSE:  STATEMENT OF PURPOSE:  This resolution authorizes acceptance of a temporary construction easement in conjunction with the Kenwood/Arrowhead Signal and Roadway Improvements project.
