AN ORDINANCE AUTHORIZING A STREET EASEMENT TO THE CITY OF RICE LAKE OVER, UNDER AND ACROSS REAL PROPERTY AT THE RILEY ROAD TREE FARM FOR NOMINAL CONSIDERATION.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. That the proper city officials are hereby authorized to grant a street easement to the City of Rice Lake, municipal corporation and political subdivision created and existing under the laws of the State of Minnesota, and enter into an easement agreement for street purposes, substantially in the form attached as Exhibit 1, over, under and across the real property described and depicted on Exhibit A to the attached Exhibit 1, for nominal consideration.
Section 2. That this ordinance shall take effect 30 days after its passage and publication.
Statement of Purpose
STATEMENT OF PURPOSE: This ordinance authorizes a street easement to the City of Rice Lake, municipal corporation and political subdivision created and existing under the laws of the State of Minnesota (“Rice Lake”), over, under and across the real property described and depicted on Exhibit A to the attached Exhibit 1, for nominal consideration. The easement is an 80’ x 80’ area in the northwest corner of the Riley Road Tree Farm property near Riley Road and Jean Duluth Road (across the street from the Lake Park Baseball & Athletic Complex).
Rice Lake desires this easement so that it can construct, maintain, and operate a turnaround at the end of Cooper Road, which is currently a dead end. Rice Lake will be responsible for all costs and expenses related to the street and shall indemnify the City for its use of the easement area.
