AN ORDINANCE AMENDING SECTION 34-38 OF CHAPTER 34 OF THE DULUTH CITY CODE TO PROHIBIT MARKING OR PLACING SIGNS ON PRILEY FOUNTAIN.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. That Section 34-38 of Chapter 34 of the Duluth City Code is hereby amended as follows:
Sec. 34-38. Priley Fountain--prohibited conduct
No person shall put or cause to be put any substance into the water of Priley Fountain; nor shall any person enter, disturb or occupy the water of said fountain, or cause said water to be entered, disturbed or occupied by any other person; nor shall any person cause any animal to enter the water of said fountain, or permit any animal in his possession and under his control to enter or remain in said water; nor shall any person apply any markings or drawings upon any part of Priley Fountain; nor shall any person affix any signage or object upon any part of Priley Fountain. This Section shall not be applicable to person responsible for the care and maintenance of said fountain while performing such responsibilities.
For the purpose of applying this Section, Priley Fountain shall be considered to be that public artificial water fountain encircled by Priley Drive, and located between city hall and the federal building in the city of Duluth.
Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this ordinance is to recognize the historical importance and value of the Priley Fountain and to protect it against any actions that could result in impairment or damage to the fountain.
