CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a three-year agreement, substantially in the form attached as Exhibit 1, with Duluth Amateur Hockey Association for the lease of the city's Fryberger Arena for nominal consideration.

Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a three-year agreement with Duluth Amateur Hockey Association ("DAHA") for the lease of the city's Fryberger Arena (the "Arena") to provide hockey programing for youth ages 3-14. DAHA has used and operated this facility for many years under previous agreements.

There is no usage fee associated with this agreement because of the public benefit provided by DAHA's provisions of its services. However, DAHA is responsible to reimburse the city for any and all utilities furnished to the Arena between October 1 and March 31 in years one and two of the agreement and pay for any and all utilities in year three of the agreement. DAHA is also responsible to perform cleaning and routine maintenance duties in the Arena to keep it in good order and condition and absorb all costs related thereto, as well as provide those items required for the daily operation of the Arena (e.g. paper products, plastic products, and light bulbs).

City will be responsible for electricity, steam, water, sewer, and gas utilities furnished to the Arena in between April 1 and September 30 in years one and two of the agreement, but will not pay for any utilities in year three. In its sole discretion, City may perform necessary major repairs and non-routine maintenance to the structural and mechanical components of the Arena.
