CITY PROPOSAL:
WHEREAS, resolution 22-0778R authorized the proper City officials to accept a $100,000 Lake Superior Coastal Program grant from the Minnesota Department of Natural Resources to replace two beach dune-crossing boardwalks on Minnesota Point, one near the Lafayette Community Center and one within the Park Point Recreation Area; and

WHEREAS, economic inflation and the rising cost of steel and transportation have resulted in this project being divided into two phases (Phase 1: Lafayette Community Center, Phase 2: Park Point Recreation Area); and

WHEREAS, resolution 23-0215R authorized the first amendment accepting additional funding for a total award not to exceed $108,182 to support an archeological survey and
Tribal monitoring by the Fond du Lac Band of Lake Superior Chippewa during the archeological survey process and during project implementation, and for which no additional match funds are required; and

WHEREAS, the archeological survey has been completed as required, and additional time is needed to complete the boardwalk installation.

NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are hereby authorized to execute the second amendment to the grant agreement (City contract No. C24400) with the Minnesota Department of Natural Resources, substantially in the form attached hereto as Exhibit A, amending the scope to include one boardwalk replacement (Lafayette Community Center) and extending the term of the contract from an original expiration date of November 30, 2023 to December 31, 2024.

FURTHER RESOLVED, the City of Duluth has the legal authority to accept these funds and the financial, technical, and managerial capacity to ensure proper planning and maintenance of the project.
