RESOLUTION ENDORSING A MODIFICATION TO THE COUNCIL’S FIVE YEAR PHASE-OUT OF THE STREET LIGHTING FEE PLAN APPROVED BY RESOLUTION 14-0611 TO DEFER A PORTION OF THE 2017 SCHEDULED REDUCTION TO THE STREET LIGHTING FEE.

BY PRESIDENT FILIPOVICH AND COUNCILOR SIPRESS:

                     WHEREAS, the city council eliminated the street lighting system utility effective December 31, 2019, by Ordinance 14-037; and

                     WHEREAS, the city council endorsed a five-year phase-out of the street lighting utility in a gradual and planned manner by Resolution 14-0611; and

                     WHEREAS, in response to the recent Minnesota Supreme Court ruling in First Baptist Church of St. Paul v. City of St. Paul, 884 N.W.2d 355 (Minn. 2016), the city administration proposed and the city council approved an elimination of the street maintenance fee effective in 2017, significantly reducing the city’s reliance on mandatory fees.

                     THEREFORE, BE IT RESOLVED, that the city council modifies its five-year phase-out plan of the street lighting fees by deferring a portion of the 2017 scheduled reduction in the street lighting fee as outlined in the attached Exhibit A, while maintaining the 2019 target for complete elimination of the street lighting fee.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution modifies the city council’s policy of incrementally eliminating the street lighting fee by 2019 by reducing the planned reduction in the street lighting fee in 2017 and increasing the planned reductions in the street lighting fee for 2018 and 2019.
