AN ORDINANCE AUTHORIZING THE CONVEYANCE OF CERTAIN REAL PROPERTY ABUTTING RIDGEVIEW ROAD TO THE STATE OF MINNESOTA FOR AN ENTRANCE TO THE AIR NATIONAL GUARD FACILITY.

CITY PROPOSAL:
The city of Duluth does ordain:

Section 1. Pursuant to Section 2-176(a) of the Duluth City Code, 1959, as amended (the "Code"), the city council stated its intention to sell or convey certain property as set forth in Resolution 16-0248.

Section 2. Pursuant to Section 2-177.3 of the Duluth City Code, 1959, as amended, the city of Duluth ("city") may convey city property to another governmental entity if the needs of said governmental unit are greater in importance than the need of the city to retain said property and that the best interests of the citizens of the city will be best served by accomplishing such conveyance. Accordingly, the city council finds that:

(a) The needs of the state of Minnesota in having a secondary controlled access to the Air National Guard Base from Ridgeview Road are greater in importance than the need of the city to retain the property; and

(b) The best interests of the citizens of the city will be best served by conveyance of the Property to the state of Minnesota to allow construction of a secondary access point from Ridgeview Road; and

(c) The St. Louis County Assessor has provided a written estimate of the market value of the property to be subject to the conveyance of $46,300. The city will convey the Property for nominal consideration of $1.00; and

(d) Pursuant to Section 2-176(b) of the Code, the City's planning department reviewed the proposed conveyance of the Property for conformity to the City's comprehensive plan and reported that the conveyance of the Property to St. Louis County conforms with said comprehensive plan, as shown on the attached Exhibit A.
