RESOLUTION ACCEPTING A TRAIL EASEMENT AND A CONSERVATION EASEMENT FROM GRAND AVENUE ESTATES OF DULUTH, LLC.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept, on behalf of the general public and at no cost to the city, an easement from Grand Avenue Estates of Duluth, LLC, that is attached hereto as Exhibit A, dedicating to the general public a 30 foot trail easement, and an easement attached hereto as Exhibit B, dedicating to the general public a conservation easement over Outlots A and B in the Grand Avenue Estates subdivision.
Statement of Purpose
STATEMENT OF PURPOSE: The resolution authorizes the acceptance of a trail easement for public use, and a conservation easement. The trail easement grants the city and its permittees and licensees the right of ingress and egress, and the right to remove obstructions from the 30 foot wide easement. The conservation easement preserves the two outlots in the development as open space, and prohibits the placement of structures or the use of off road vehicles in the conservation area.
A trail easement and a conservation easement were both conditions of approval for the Grand Avenue Estates final plat, approved by the planning commission on June 9, 2015. Grand Avenue Estates (formerly known as Westwood Heights) was zoned to R-P (Residential-Planned) in 2012, and provides for the development of two multi-family structures and ten single-family structures, accessed by a private road.
