CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from the Duluth Economic Development Authority, an economic development authority under MN Statutes Chapter 469, a perpetual easement for utility purposes over, under, and across the real property legally described and depicted on Exhibit A to the attached Exhibit 1, for nominal consideration.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a permanent easement for utility purposes from the Duluth Economic Development Authority (“DEDA”) over, under, and across certain property in the Lincoln Park neighborhood for nominal consideration. The utility easement area is located on the northerly side of W. Michigan Street between S 29th Ave. W. and S 30th Ave. W. The acceptance and recordation of this easement ensures that the City has the proper rights for an existing gas main.
