RESOLUTION ACCEPTING PERMANENT EASEMENT FOR UTILITY PURPOSES FROM STATE OF MINNESOTA, BY AND THROUGH THE BOARD OF TRUSTEES OF THE MINNESOTA STATE COLLEGES AND UNIVERSITIES OVER, UNDER, AND ACROSS CERTAIN REAL PROPERTY IN THE DULUTH HEIGHTS NEIGHBORHOOD, AT NO COST TO THE CITY.

CITY PROPOSAL:

                     RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from the State of Minnesota, by and through the Board of Trustees of the Minnesota State Colleges and Universities, a perpetual, nonexclusive easement for utility purposes over, under, and across the real property legally described and depicted on Exhibit A attached to Exhibit 1, at no cost to the City.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a perpetual, nonexclusive easement for utility purposes (the “Easement”) from the State of Minnesota, by and through the Board of Trustees of the Minnesota State Colleges and Universities (“MnSCU”), over, under, and across certain real property (the “Easement Area”) in the Duluth Heights neighborhood, at no cost to the City.  The Easement Area is a part of the Lake Superior College campus off of Trinity Road. 

 

The Easement is needed in connection with an upcoming multifamily project south of Lake Superior College titled “The Legacy Lake Superior Residences” (the “Project”).  Water and sanitary mains will be installed by the developer of the Project within the Easement Area and then turned over to the City for operation and maintenance.

 

The acceptance of this Easement creates public rights in the Easement Area so the City can operate, maintain and repair the public utilities.
