AN ORDINANCE DEDICATING PERPETUAL EASEMENTS FOR UTILITY PURPOSES OVER CITY-OWNED PROPERTY.

CITY PROPOSAL:

The city of Duluth does ordain:

                     Section 1.  That the city of Duluth does hereby dedicate to the general public a perpetual easement for utility purposes over, under and across real property located in St. Louis County, Minnesota legally described and depicted on the attached Exhibit A.

                      Section 2.  That the city of Duluth does hereby dedicate to the general public a perpetual easement for utility purposes over, under and across real property located in St. Louis County, Minnesota legally described and depicted on the attached Exhibit B.

Section 3.  That the proper city officials are authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this ordinance showing the easements to be dedicated. 

                     Section 4.  That this ordinance shall take effect 30 days after its passage and publication.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this ordinance is to dedicate perpetual easements for utility purposes across certain city-owned property within the boundary of the Duluth Airport.  The easement area is north of Airport Road and east and west of soon to be vacated Stebner Road. 

 

The Duluth Airport Authority (“DAA”) is working on a project for a new air traffic control tower (the “Tower”).  The site for and around the Tower is currently being reconfigured through street and utility vacations, a minor subdivision, and dedication of new easements.  This easement is needed for public utilities within the site, as well as access to said utilities.
