RESOLUTION ACCEPTING A PERMANENT EASEMENT FOR STREET AND UTILITY PURPOSES NEAR KENWOOD AVENUE AND ARROWHEAD ROAD FROM INFINITY MANAGEMENT, INC.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement for street and utility purposes as described in the Easement Agreement attached as Exhibit A from Infinity Management, Inc., a Minnesota corporation, Grantor, over that portion of Lot 10, Block 4, KENWOOD PARK ADDITION TO DULUTH, described below:
All that part of Lot 10, Block 4, KENWOOD PARK ADDITION TO DULUTH, St. Louis County, Minnesota lying northwesterly of Line "A" hereinafter described and southeasterly of Line "B" hereinafter described. Said Line "Be" being the same line described in Roadway Easement Document Number 613372 as recorded in the Office of Registrar of Titles, St. Louis County, Minnesota.
LINE "A"
Commencing at the northwest corner of said Lot 10, thence easterly along the north line of said Lot 10, a distance of 19.50 feet to the Point of Beginning of the line to be described, thence southwesterly to a point on the west line of said Lot 10, distant 15.50 feet southerly of said northwest corner and said line there terminating.
LINE "B"
Beginning at a point on the easterly right of way line of Kenwood Avenue 48.00 feet south of the centerline of Arrowhead Road, thence northeasterly to a point on the southerly right of way line of Arrowhead Road, distant 48.00 feet east of the centerline of Kenwood Avenue and said line there terminating.
Subject to the reservation to the property of the right to maintain, repair, operate and reconstruct a pylon sign having a maximum height of 15 feet and a base of not more than 3 feet by 3 feet in size at its current location as shown on Attachment 1 referenced below, including electrical and applicable thereto including in any nonconforming status.
The easement to be granted is as depicted on Attachment 1.
