CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to amend Agreement L31209 with AMI Consulting Engineers to provide professional services for flood damage repair projects at multiple locations from three separate storm events as identified in the attached Exhibit A, for an increase of $268,126.00, and new contract total of $868,026.00, payable from the following funds.

Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes Amendment No. 1 to Agreement L31209 with AMI Consulting Engineers to provide additional professional services for flood damage repair projects at multiple locations resulting from three separate storm events for an increase of $268,126.00 and new contract total of $868,026.00. The City will use its disaster fund and in-kind contributions of staff time to fulfill the local match requirement.
The original agreement authorized AMI Consulting Engineers to design, permit, and manage more than 100 small-to-medium-sized flood damage repair projects located throughout the city. The damage resulted from three separate state and/or federally declared flood disasters occurring in 2023 and 2024 and primarily affected parks, trails, culverts, bridges, retaining walls, stream crossings, and gravel roads and paths.
The amendment extends the contract completion date from June 30, 2026, to June 30, 2027, and increases the contract amount to compensate for additional engineering, permitting, surveying, hydraulic modeling, construction administration, and related professional services that were not reasonably anticipated at the time of contract award.
During project development, AMI identified significant discrepancies in FEMA site documentation, including inaccuracies in site locations, damage descriptions, and quantities, requiring additional field verification to ensure the project scope accurately reflected existing conditions. In addition, changes in permitting requirements by the Minnesota Department of Natural Resources (MnDNR) and the Minnesota Pollution Control Agency (MPCA), together with expanded hydraulic analysis, topographic survey, and environmental review requirements, substantially increased the professional services necessary to obtain regulatory approvals. The amendment also addresses an extended construction schedule resulting from the number of project sites, agency review timelines, and limitations on annual permit processing capacity.
Approval of this amendment will provide the resources and schedule necessary to complete the required design, permitting, construction administration, and regulatory coordination activities, ensuring the City's flood damage recovery projects remain eligible for funding, comply with applicable state and federal requirements, and can be completed in an efficient and timely manner.
State and federal disaster recovery funding will reimburse the majority of eligible project costs, allowing the City to restore public infrastructure while minimizing the required local financial contribution.
A RFP was issued on January 1, 2025, and two bids were received as listed below. AMI Consulting Engineers was highest graded bid.
