CITY PROPOSAL:

                     RESOLVED, that the proper city officials are authorized to execute an administrative order on consent, substantially in the form of the attached Exhibit A, to resolve deficiencies as defined under the Safe Drinking Water Act (“SDWA”) and as determined by the Environmental Protection Agency Region 5 (“EPA”), concerning the city of Duluth’s public drinking water system.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of the administrative order on consent (“AOC”) is to further the objectives of the Safe Drinking Water Act (“SDWA”) and to adopt a corrective action plan to ensure the safety of the city’s drinking water.  The corrective action plan will include operations and maintenance checklists, inspections, assurance of qualified staff, and timely reporting to the EPA. The AOC will remain in effect until the EPA has reviewed the final report and determined that all the requirements of the AOC have been completed and implemented and no further actions are necessary to comply with the SDWA. The EPA will provide notice to the city when the AOC is deemed terminated.
