RESOLUTION AUTHORIZING AGREEMENT WITH DULUTH SEAWAY PORT AUTHORITY AUTHORIZING THE CITY TO DEPOSIT SNOW ON ERIE PIER AT NO COST.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into an agreement, a copy of which is attached hereto as Exhibit A, with the Duluth seaway port authority to allow the city to store snow removed from streets and public grounds on Erie Pier at no cost to the city.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize an agreement with the port authority to allow the city to dispose of snow removed from city streets and other public grounds on Erie Pier at no cost to the City. This agreement is similar to the one the city entered into with the port authority last year. Since last year’s agreement proved to work well for both parties, this agreement will run until June 30, 2024.
The snow from snowfalls in congested areas needs to be hauled from where it fell to a location where it can be stockpiled and allowed to dissipate naturally. Erie Pier has a number of advantages for that purpose including the facts that it’s at the elevation of and in the areas of the property that generates the most snow in need of such removal (downtown, Canal Park, and the other commercial areas proximate to the lake), that transportation costs will be reduced and the property is not in high demand over the winter season.
The port authority is willing to allow the city to use that property upon the condition that the city keep the property clean and that it will indemnify the port authority for any damage that it causes.
