RESOLUTION VACATING A PLATTED STREET EASEMENT FOR VANDENBERG DRIVE NORTH AND SOUTH OF AIRPORT ROAD, AND A PLATTED ALLEY EASEMENT SOUTH OF AIRPORT ROAD, AND RETENTION OF PUBLIC UTILITY EAESEMENTS.

CITY PROPOSAL:
RESOLVED, that:
(a) The city council finds a sufficient petition was filed with the city requesting the vacation described in (d) below; and
(b) Pursuant to Section 100 of the City Charter and Section 50-37.6 of Chapter 50 of the Duluth City Code, as amended, such petition was duly referred to the city planning commission and such commission gave due notice of public hearing and did consider same in a public hearing and the city planning commission found that this portion of the street easement is useless for all purposes; and
(c) The city planning commission, at its Tuesday, February 9, 2016 regular meeting, recommended approval of the vacation petition; and
(d) The city council of the city of Duluth approves the vacation of the street easement, and the dedication of a pedestrian easement, described below:
VANDENBERG DRIVE NORTH OF AIRPORT ROAD VACATION AND UTILITY EASEMENT RETENTION LEGAL DESCRIPTION:
All that part of the 20.00 foot wide right of way lying between Lots 2 and 3, Block 4, AIRPORT DIVISION, according to the recorded plat thereof, St. Louis County, Minnesota.
Said parcel contains 8,226 square feet or 0.19 acres, more or less.
VANDENBERG DRIVE SOUTH OF AIRPORT ROAD AND ALLEY VACATION AND UTILITY EASEMENT RETENTION LEGAL DESCRIPTION:
All that part of Vandenberg Drive lying between Blocks 2 and 3, AIRPORT DIVISION, according to the recorded plat thereof, St. Louis County, Minnesota.
AND
All that part of the 33 foot wide alley lying southerly and adjacent to Lots 1, 2, and 3, Block 3, AIRPORT DIVISION, according to the recorded plat thereof, St. Louis County, Minnesota.
Said above described parcels contain 34,060 square feet or 0.78 acres, more or less.
