RESOLUTION DEDICATING AN EASEMENT FOR HIGHWAY PURPOSES ON PROPERTY ADJACENT TO MESABA AVENUE AND WEST 7TH STREET.

CITY PROPOSAL:

RESOLVED, that the city of Duluth does hereby dedicate to the general public an easement for highway purposes over city-owned property in St. Louis County, Minnesota legally described as Lot Seven (7), Block Eighty-nine (89), DULUTH PROPER THIRD DIVISION.

FURTHER RESOLVED, that the proper city officials are authorized to record with the St. Louis County Recorder and/or Registrar of Titles of St. Louis County, Minnesota, a certified copy of this resolution effectuating the dedication granted under this resolution.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution dedicates to the general public an easement for highway purposes over city-owned property in St. Louis County, Minnesota legally described as Lot Seven (7), Block Eighty-nine (89), DULUTH PROPER THIRD DIVISION.  An aerial view of the property dedicated for highway purposes under this resolution is depicted in red on the attached Exhibit A.

 

Lot 7 is located at the intersection of Mesaba Avenue and West 7th Street.  A portion of Lot 7 is already used for street and highway purposes without the formal dedication of an easement.  The city acquired the fee title to Lot 7 in 1971 under a deed from the State of Minnesota free from any conditions or restrictions.

 

After the dedication of the highway easement and in conjunction with a Mesaba Avenue project, the state of Minnesota, Department of Transportation, will take over Lot 7 by Commissioner’s Orders and make the improvements shown on the attached Exhibit B.
