AN ORDINANCE DEDICATING A PERPETUAL EASEMENT TO THE GENERAL PUBLIC FOR CONNECTION OF A PEDESTRIAN PASSAGEWAY BRIDGE OVER CITY-OWNED PROPERTY.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. That the city of Duluth does hereby dedicate to the general public a perpetual easement for connection of a pedestrian passage bridge to be used in connection with the Skywalk System, as defined in Chapter 44A of the Duluth City Code, 1959, as amended, over and across certain city-owned real property located within that portion of Lot 16, Block 26, PORTLAND DIVISION OF DULUTH, St. Louis County, Minnesota legally described on the attached Exhibit A.
Section 2. That the proper city officials are authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this ordinance showing the easement to be dedicated.
Section 3. That this ordinance shall take effect 30 days after its passage and publication.

Statement of Purpose
STATEMENT OF PURPOSE: This ordinance authorizes the dedication of a permanent easement in favor of the general public across city-owned property for the connection of a pedestrian passageway bridge in the Medical District Parking Ramp. The bridge serves as a connection between the Medical District Parking Ramp to the new Vision Northland hospital owned by St. Mary's Duluth Clinic System.

This bridge existed prior to the new Vision Northland hospital, but was replaced in the same location during construction. The demolition of the previously existing skywalk and the construction of the new Skywalk was funded with State of Minnesota appropriation bond proceeds authorized under the Regional Exchange District legislation, Minnesota Laws 2019, 1st Special Session Chapter 6, Article 10, as amended by Section 1 of Laws of Minnesota 2021, 1st Special Session Chapter 9.
