RESOLUTION AUTHORIZING AGREEMENT WITH DEDA FOR SNOW STORAGE ON LOT D.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a license agreement substantially in the form of that attached as exhibit A with the Duluth Economic Development Authority (“DEDA”) for storage of snow on DEDA’s lot D from street clearing operations for the 2016-17 snow season at no cost to the City.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize a license agreement with DEDA to allow the city to use DEDA’s lot D in Bayfront to store snow from street snow clearing operations for the 2016-17 snow season.
As it has in the recent past, the city has requested that DEDA allow the use of lot D for seasonal snow storage and DEDA has agreed to do so on the same terms as in prior years. Among those conditions are a requirement that DEDA first get a technical assistance letter to cover the storage use, that the city agree to have any remaining snow dealt with and the property cleaned of any debris resulting from show storage operations by May 1st and that the city cover any liability arising out of or resulting from the snow storage operations.
DEDA is in the process of securing a developer for lot D and will anticipates entering into an option agreement at some point in the near future. DEDA expects to make every effort to not allow that option to interfere with the snow storage on the site or the use of lot D for parking for Bentleyville but if necessary to the development process, the agreement does allow DEDA to terminate the agreement early.
