RESOLUTION AUTHORIZING THE CITY TO ENTER INTO AGREEMENT NO. 1051373 WITH THE MINNESOTA DEPARTMENT OF TRANSPORTATION TO PROVIDE PAYMENT TO STATE FOR THE CITY’S SHARE OF THE WORK ON TRUNK HIGHWAY 23.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into an agreement, substantially in the form of the attached Exhibit A, with the Minnesota Department of Transportation to provide payment by the City of Duluth to the State for the City’s share of the costs for the storm sewer, lighting and utility construction, and other associated construction to be performed upon, along, and adjacent to Trunk Highway No. 23 from 633 feet south of St. Louis County State Aid Highway No. 3 “CSAH 3” (Becks Road) to 268 feet south of CSAH 3 within the corporate City limits under State Project No’s. 6910-102 and 6910-103, (city project nos.1768 and 1769), the estimated city share of the project is $254,864.52.

FURTHER RESOLVED, that the Mayor and the City Engineer are authorized to execute the Agreement and any amendments to the Agreement.
Statement of Purpose
STATEMENT OF PURPOSE: MnDOT is about to perform grading, bituminous surfacing, lighting and bridge construction on T.H. 23 in 2023. This work will require a detour of traffic to West Gary Street. The city will be reimbursed for maintenance and road life consumed by the detour as per the agreement approved by the city on September 12, 2022. In addition, the city granted municipal consent for the project on October 25, 2021. This agreement provides for the city to reimburse MnDOT for its share of the lighting and utility improvements to be performed this summer.
