RESOLUTION AUTHORIZING AN AMENDMENT TO AGREEMENT 23926 WITH THE DULUTH CLIMBERS COALITION FOR THE CONTINUED DEVELOPMENT AND OPERATION OF ICE FARMING INFRASTRUCTURE AT QUARRY PARK.

CITY PROPOSAL:
WHEREAS, resolution 20-0472R authorized a development and operation agreement with the Duluth Climbers Coalition for the construction, operation, and maintenance of ice farming infrastructure at Quarry Park; and
WHEREAS, the Duluth Climbers Coalition and the City have determined that it is mutually beneficial to pursue continuation of the development and operation of ice farming at Quarry Park with an amendment to the existing agreement.
NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are hereby authorized to execute the first amendment, substantially in the form attached as Exhibit A, to the existing development and operation agreement (City contract No. 23926) with the Duluth Climbers Coalition, for the continued operation and maintenance of ice farming infrastructure at Quarry Park, at no cost to the City.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the first amendment, substantially in the form attached as Exhibit A, to the development and operation agreement (City contract No. 23926) with the Duluth Climbers Coalition (DCC) for the continued operation and maintenance of ice farming infrastructure at Quarry Park, at no cost to the City. The amendment extends the term of the agreement to expire on May 31, 2026, and amends the language regarding the ice farming cycle to allow cycles to occur as necessary. The City and DCC have both taken steps to upgrade infrastructure and equipment serving the ice farming operation, and the adjacent properties. These upgrades have created a system with sufficient water pressure to support the ice farming and adjacent properties, which renders time constraints on the cycles unnecessary.
