RESOLUTION AUTHORIZING A LICENSE AGREEMENT BETWEEN THE CITY OF DULUTH AND THE LAKE SUPERIOR AND MISSISSIPPI RAILROAD.

CITY PROPOSAL:

WHEREAS, the Lake Superior and Mississippi Railroad uses city-owned railroad trackage between Munger Landing and Boy Scout Landing to provide scenic train excursions.

 

NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are hereby authorized to enter into a License Agreement, substantially in the form of the attached Exhibit A, with the Lake Superior and Mississippi Railroad for the continued use of city-owned railroad trackage through December 31, 2028.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the execution of a license agreement, substantially in the form of Exhibit A, with the Lake Superior and Mississippi Railroad (LSMR) for the continued use of city-owned railroad trackage through December 31, 2028. The License defines the track portions and conditions allowed for passenger use, and also describes maintenance and safety expectations.

 

In the late 1970’s and early 1980’s, the City acquired certain railroad right-of-way from the Burlington Northern Railroad, including trackage between Munger Landing and Boy Scout Landing.  LSMR, a nonprofit corporation, has operated a popular educational excursion train on the track for a number of years pursuant to an agreement between the City and LSMR. 

 

There is no fee charged for LSMR’s continued use of city-owned railroad trackage.  LSMR provides all operational and maintenance services for the excursion train, trackage, and equipment, as well as associated costs.
