RESOLUTION DEDICATING A 16 FEET OF LOT 1, BLOCK 4 AND THE WESTERLY 4.00 FEET OF THE PLATTED 20.00 FOOT WIDE ALLEY BETWEEN BLOCKS 3 AND BLOCK 4 OF THE RECORDED PLAT OF "LAKESIDE GARDENS."

CITY PROPOSAL:
RESOLVED, that:
(a) The city council finds a sufficient petition was filed with the city requesting the vacation described in (d) below; and
(b) Pursuant to Section 100 of the City Charter and Section 50-37.6 of Chapter 50 of the Duluth City Code, as amended, such petition was duly referred to the city planning commission and such commission gave due notice of public hearing and did consider same in a public hearing and the city planning commission found that this portion of the street easement is useless for all purposes; and
(c) The city planning commission, at its Tuesday, August 9, 2016 regular meeting, recommended approval of the vacation petition; and
(d) The city council of the city of Duluth approves the vacation of the easement described below:
VACATION LEGAL DESCRIPTION:
Those parts of the Easterly 16.00 feet of Lot 1, Block 4 and the Westerly 4.00 feet of the platted 20.00 foot wide alley between Blocks 3 and said Block 4, of the recorded plat of "LAKESIDE GARDENS" on file and of record in the office of the St Louis County Recorder, St Louis County, Minnesota, described as follows:
Commencing at the southeasterly corner of said platted 20.00 foot wide alley; thence westerly, along the southerly line of said platted 20.00 foot wide alley, a distance of 16.00 feet to the actual point of beginning of the tract of land herein described; thence northerly, parallel with the easterly line of the platted 20.00 foot wide alley, a distance of 120.00 feet; thence westerly, parallel with said southerly line of the platted 20.00 foot wide alley, a distance of 4.00 feet; thence northerly, parallel with said easterly line of the platted 20.00 foot wide alley, a distance of 100.00 feet; thence easterly, parallel with said southerly line of the platt...
