RESOLUTION AUTHORIZING A THREE-YEAR LICENSE AGREEMENT WITH COMPANIES TO CLASSROOMS, DULUTH FOR THE EXCLUSIVE USE OF THE GRANT RECREATION CENTER FOR OPERATION OF ITS SERVICES.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to execute a three-year license agreement, substantially the same as the agreement attached as Exhibit 1, with Companies to Classrooms, Duluth, a Minnesota nonprofit corporation, for the exclusive use of the Grant Recreation Center.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes a new, three-year license agreement with Companies to Classrooms for exclusive use of the Grant Recreation Center for operation of its services.  Grant Recreation Center is located at 901 East 11th Street.

 

Companies to Classrooms is a nonprofit that supports youth education by soliciting donations of classroom materials and making those materials available to teachers throughout the region at no cost. The organization has used Grant Recreation Center since 2021 under an agreement that is expiring.

 

The City ceased programming at Grant Recreation Center many years ago following budget cuts. Companies to Classrooms is permitted to use the building on the condition that they are exclusively responsible for all costs associated with its use including, but not limited to, cleaning, maintenance, repairs and utilities.  The City has no obligations with respect to Companies to Classroom’s occupancy of the Grant Recreation Center or the building itself. Either party may terminate the agreement with thirty (30) days’ written notice.

 

In contrast to the previous agreement, the new agreement shifts control of the exterior water spigots from Companies to Classrooms back to the City so as to make it possible for multiple community groups to use those spigots including, but not limited to, Companies to Classrooms.
