RESOLUTION AUTHORIZING ACCEPTANCE OF A QUIT CLAIM DEED FROM THE STATE OF MINNESOTA, DEPARTMENT OF TRANSPORTATION, FOR REAL PROPERTY ADJACENT OR NEAR CENTRAL ENTRANCE FOR TRUNK HIGHWAY PURPOSES.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept the conveyance of real property legally described on the quit claim deed attached as Exhibit A from the State of Minnesota, Department of Transportation, for trunk highway purposes, at no cost to the city. 

FURTHER RESOLVED, that the proper city officials are also hereby authorized to disburse funds to pay for the filing fees associated with the recordation of the quit claim deed, payable from Fund 110-700-1420-5441 (General Fund-Transfers and Other Functions-Capital Program-Other Services and Charges).

 

Statement of Purpose

STATEMENT OF PURPOSE:  The purpose of this resolution is to accept the conveyance of certain real property from the State of Minnesota, Department of Transportation, for trunk highway purposes. 

 

In 1993, the State of Minnesota conveyed to the City of Duluth numerous parcels of real property adjacent to or near Central Entrance.  The parcels included in the quit claim deed are depicted on the maps attached as Exhibit B.  For unknown reasons, the quit claim deed was not filed for record and there was no evidence of the city’s interest in the real property.  The quit claim deed was filed with the St. Louis County Recorder on August 25, 2015, and still needs to be recorded with the St. Louis County Registrar of Titles. 

 

In order to record the quit claim deed with the Registrar of Titles, the city needs to formally accept the property through a resolution.  The acceptance of the real property and subsequent filing of this resolution and the aforementioned quit claim deed will effectuate the conveyance of property from the State of Minnesota to the City of Duluth.
