RESOLUTION AUTHORIZING THE EXECUTION OF A DECLARATION OF RESTRICTIVE COVENANT FOR CHAMBERS GROVE PARK.

CITY PROPOSAL:
WHEREAS, the City of Duluth (City) entered into Grant Agreement PTF13-003 with the Minnesota department of natural resources (MnDNR) for parks and trails legacy grant monies for the purpose of restoration and improvements at Chambers Grove Park under Resolution 13-0508; and
WHEREAS, a condition of the grant agreement and acceptance of grant monies requires that the City commits the property to public use; and
WHEREAS, the City is required to obtain state approval before any portion of the parks system developed using grant monies is wholly or partially converted to any use other than the use authorized in the grant agreement.
NOW THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to execute the Declaration of Restrictive Covenant, substantially in the form attached as Exhibit A, over the following described real property, more commonly known as Chambers Grove Park:
That part of Government Lot 1, Section 7, Township 48 North, Range 15 West of the Fourth Principal Meridian, lying Easterly of the Easterly bank of the St. Louis River, lying Westerly of the West line of FOND DU LAC, according to the recorded plat thereof, and lying Northwesterly of the Northwest right of way line Highway No. 23.
FURTHER RESOLVED, that the proper city officials are hereby directed to file the Declaration of Restrictive Covenant with the St. Louis county recorder and/or registrar of titles in order to properly effectuate this restrictive covenant.

STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the execution and filing of a Declaration of Restrictive Covenant at Chambers Grove Park, as required under the terms of Grant Agreement PTF13-003 with the Minnesota Department of Natural Resources (MnDNR).
