AN ORDINANCE DESIGNATING THE LAKE SUPERIOR AND MISSISSIPPI RAILROAD AS A DULUTH HERITAGE PRESERVATION LANDMARK.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. Under the authority of Section 50-37.8 of the Duluth Legislative Code, 1959, as amended, the city of Duluth does designate the Lake Superior and Mississippi Railroad, from Boy Scout Landing on the west to Spring Street on the east, as a Duluth heritage preservation landmark, as documented in Attachment 1;
Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.
Statement of Purpose
STATEMENT OF PURPOSE: This ordinance designates the Lake Superior and Mississippi Railroad, from Boy Scout Landing on the west to Spring Street on the east, as a Duluth heritage preservation landmark. On October 9, 2018, the Duluth Heritage Preservation Commission (HPC) voted 5 yeas, 0 nays, and 1 abstention to recommend the landmark designation, with a stipulation to the motion that serious consideration be given in the landmark’s preservation plan to develop a Memorandum of Understanding related to environmental cleanup and historic preservation that is acceptable to all parties. Preceding this action was a public hearing held by the HPC on September 11, 2018, and a recommendation to proceed by the planning commission on August 14, 2018. Planning commission continued its recommendation at its June 11, 2019 meeting.
