AN ORDINANCE DEDICATING A PERPETUAL EASEMENT TO THE GENERAL PUBLIC OVER AND ACROSS CITY-OWNED PROPERTY FOR TRAIL AND OTHER RECREATIONAL PURPOSES.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. That the city of Duluth does hereby dedicate to the general public a perpetual easement for trail and other recreational purposes over and across certain real property located in St. Louis County, Minnesota legally described and depicted on the attached Exhibit A.
Section 2. That the proper city officials are authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this ordinance showing the easement to be dedicated.
Section 3. That this ordinance shall take effect 30 days after its passage and publication.
Statement of Purpose
STATEMENT OF PURPOSE: This ordinance authorizes the dedication of a perpetual easement in favor of the general public across certain city-owned property for trail and other recreational purposes. The real property affected by this ordinance is the city-owned portions of the Lakewalk Trail between the head of Lake Superior (near the Endion Station Bathroom) and 27th Ave. E.
Resolution No. 23-0162 authorized the City to apply for a United States Department of Transportation Grant for "Rebuilding American Infrastructure with Sustainability and Equity" for resilient rehabilitation of the Lakewalk (the "Grant"). The Grant was awarded and will fund the following activities: (i) restoration and stabilization of portions of the shoreline, (ii) retreatment and rehabilitation the Lakewalk in certain sections, (iii) increase neighborhood and Downtown connectivity to the Lakewalk, (iv) improvement accessibility and safety, and (v) reduction of congestion on the Lakewalk (collectively, the "Project").
