RESOLUTION OF INTENT TO CONVEY CERTAIN REAL PROPERTY WITHIN THE CITY OF DULUTH ABUTTING RIDGEVIEW ROAD TO THE STATE OF MINNESOTA FOR AN ENTRANCE TO THE AIR NATIONAL GUARD FACILITY.

CITY PROPOSAL:
WHEREAS, Section 2-176 of the Duluth City Code, 1959, as amended, requires that prior to any city-owned property being offered for sale or conveyance, the city council shall, by resolution, state its intention to sell or convey such property; and
WHEREAS, the state of Minnesota department of military affairs is the owner of certain property adjacent to property owned by the city of Duluth; and
WHEREAS, the state of Minnesota has extended gravel, pavement, landscaping, and fencing encroaching onto the City-owned property, and wishes to make further improvements to and acquire the property in order to have a second access point to the Air National Guard Base from Ridgeview Road; and
WHEREAS, the estimated market value of the property is $46,300; and
WHEREAS, the city's planning agency has reviewed the conveyance for conformity with the city's comprehensive plan and reported its findings that the conveyance is in conformity with the comprehensive plan; and
WHEREAS, the needs of the State of Minnesota in having a secondary access point to the Air National Guard Base are greater in importance than the need of the City to retain said property, and the City wishes to convey the real property to the state of Minnesota for nominal consideration of $1.00;
NOW, THEREFORE, BE IT RESOLVED, that the Duluth city council hereby states its intention to offer for sale or conveyance property in the City of Duluth legally described and depicted on the attached Exhibit A to the state of Minnesota.
