RESOLUTION ADOPTING INTERIM CONTROLS PENDING FINAL DECISION REGARDING ENACTMENT OF A MORATORIUM ON CERTAIN SHORT-TERM RENTAL PERMITS

 

Body

CITY PROPOSAL:

WHEREAS, on October 14, 2025, the Duluth city council will introduce Ordinance No. 25-028-O (the “Interim Ordinance”), which provides for imposing a moratorium on certain short-term rental permits pending completion of a city study weighing the need for any amendment to the city’s official controls relating to short-term rentals, as authorized under Minn. Stat. § 462.355, subd. 4;

 

NOW, THEREFORE, BE IT RESOLVED, that, pursuant to Section 50-37.3.D of the Duluth City Code, no use, development, project or subdivision for which an application has not been previously filed shall be established or expanded, and that no application for a UDC permit or approval, a license, or building permit that (a) concerns both the geographical area and subject matter of the Interim Ordinance and (b) is filed after the introduction of the Interim Ordinance, may be granted or further processed pending a final decision on the adoption of the Interim Ordinance.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution, adopted pursuant to the council’s authority under Section 50-37.3.D of the Duluth City Code, prohibits the city from granting or further processing any application or issuing any approval, license, or permit that concerns the short-term rental uses at issue in Ordinance No. 25-028-O, pending the council’s final decision on the adoption of Ordinance No. 25-028-O.
