RESOLUTION AUTHORIZING A FIRST AMENDMENT TO AN AGREEMENT WITH THE DULUTH AMATEUR HOCKEY ASSOCIATION FOR THE TERM NOVEMBER 1, 2020 THROUGH OCTOBER 31, 2023 RELATING TO THE USE AND OPERATION OF THE CITY’S OUTDOOR HOCKEY FACILITIES AND ADJOINING PROPERTIES.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to enter into a first amendment to an agreement with the Duluth Amateur Hockey Association, substantially in the form attached as Exhibit 1, relating to the use and operation of the city’s outdoor hockey facilities and adjoining property.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes a first amendment to an agreement with Duluth Amateur Hockey Association (“DAHA”) for the use and operation of the city’s outdoor hockey facilities and adjoining property (the “Premises”) to provide youth programing for boys and girls ages 3-10 and to create and maintain rinks that are to be used by the general public (the “Agreement”).  The term of this Agreement was November 1, 2020 through October 31, 2023.

 

Under the original Agreement approved in the depths of the 2020 pandemic economic collapse, DAHA was to have been responsible to pay for some electricity, steam, water, sewer and gas charges at the Premises beginning with the 2022-2023 winter season (November 1 through March 31).  In recognition of the neighborhood hockey association’s volunteer services to the community, the City desires to remove the financial burden of the cost of these utilities.  DAHA is still responsible to pay for cable TV, satellite, internet and any other utilities not listed above, should DAHA desire such utilities on the Premises.
