RESOLUTION AMENDING THE AREA FOR THE CONCURRENT USE PERMIT AUTHORIZED UNDER ORDINANCE 17-039.

CITY PROPOSAL:

 

WHEREAS, the city council of the city of Duluth duly authorized and approved the concurrent use permit in Ordinance 17-039 on September 11, 2017, shown in Attachment 1, allowing a deck in the platted right of way of 19th Avenue West.

                     WHEREAS, the deck planned for this space is a roofed structure resulting in a roof overhang of 12 inches beyond the previously approved concurrent use permit area, as shown in Attachment 2.

                     WHEREAS, this overhang will be 12 feet off the ground and will not impede pedestrian traffic on the sidewalk below.

NOW, THEREFORE, BE IT RESOLVED, that the concurrent use permit granted under Ordinance 17-039 is hereby amended as follows:

An additional 12 inches into the right of way of 19th Avenue West for the express purpose of a roof overhang 12 feet off the ground.

 

Statement of Purpose

STATEMENT OF PURPOSE:  The purpose of this resolution is to amend the concurrent use permit area for 1832 W Michigan Street, originally granted on September 11, 2017, for a deck within the right of way of 19th Avenue W. The amendment allows for a roof overhang an additional 12 inches beyond the original concurrent use permit.
