CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a three-year non-exclusive license agreement, substantially in the form attached as Exhibit 1, with Top Hat Carriage Services LLC for use of space in Canal Park to temporarily hitch horses and carriages for $250.00 in 2021 and $500.00 per year thereafter; funds received under this agreement shall be deposited into Fund 110, Public Administration 121, Property and Facilities Management 1222, Rent for Land 4623.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a new three-year agreement with Top Hat Carriage Services LLC (“Top Hat”) for use of space in Canal Park to temporarily hitch horses and carriages for $250.00 in 2021 and $500.00 per year thereafter. Top Hat owns and operates a horse carriage service that provides the public with recreational horse drawn carriage rides through Canal Park. The City’s previous agreement with Top Hat has now expired.
The designed space for hitching lies within the Lighthouse Lot, but outside of any parking spaces. The exact location is depicted on Exhibit A to the attached Exhibit 1. Top Hat may use the designated space seven days a week May 1 through October 31 during each year of the term between the hours of 7:00 a.m. and 10:00 p.m. However, Top Hat’s use of the space in 2021 does not begin until June 21, 2021 due to the Lakewalk reconstruction project.
