RESOLUTION AUTHORIZING THE PROPER CITY OFFICIALS TO REQUEST AND ACCEPT FROM ST. LOUIS COUNTY, ON BEHALF OF THE STATE OF MINNESOTA, CERTAIN TAX FORFEITED LAND IN THE CHESTER PARK-UMD NEIGHBORHOOD TO BE USED FOR ROAD PURPOSES.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to request and accept from St. Louis County, on behalf of the State of Minnesota, the tax-forfeited lands located in St. Louis County, Minnesota, legally described on the attached Exhibit 1, to be used for road purposes.
FURTHER RESOLVED, that the proper city officials are hereby authorized to execute all required documents in connection with the request and acceptance of the real property described above and pay all administrative fees, recording fees, and other costs associated with the conveyance; payable from Fund 411-035-5530-PI2023-2166.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the request of and accept portions of two tax-forfeited parcels (the “Parcels”) from St. Louis County, on behalf of the State of Minnesota, to be used for road purposes. The Parcels are legally described on the attached Exhibit 1.
A portion of St. Marie St. flows through the Parcels and the City has a valid easement for this portion of St. Marie St. The City will be completing a reconstruction of St. Marie St. between Woodland Avenue and Vermilion Road, which includes replacement of the existing watermain and driveway aprons, upgrades to the stormwater system, and construction of a shared use trail (the “Project”). The Project will widen the right-of-way for St. Marie St. through the Parcels, so the City needs to acquire the Parcels in order to complete the Project.
The acquisition of the Parcels will be a free conveyance under Minn. Stat. § 282.01, Subd. 1a(e)(1). The City will be responsible for paying the state’s administrative costs, recording fees and deed tax associated with the transaction.
The Parcels are approximately outlined in red on the map attached as Exhibit 2.
