CITY PROPOSAL:

The city of Duluth does ordain:

                     Section. 1.                     That under the authority of Minn. Stat. 462.3593, subd. 9 (2016), the city of Duluth does hereby opt-out of the requirements of Minn. Stat. § 462.3593 (2016), the temporary family healthcare dwellings statute.

Section 2.                     That this ordinance shall take effect 30 days after its passage and publication.

 

Statement of Purpose

STATEMENT OF PURPOSE:  Pursuant to the authority provided under Minn. Stat. 462.3593, subd. 9 (2016), this ordinance opts the city out of initial compliance with the requirements of Minn. Stat. 462.3593 (2016), the temporary family healthcare dwellings statute. The purpose of the opt-out is to provide city officials, planning staff and citizens time to review the statute in conjunction with the city’s pending process for reviewing and updating its Comprehensive Plan, a project slated for completion in 2017, including the manner in which the statute may or may not align with the city’s long-term vision for accessory or temporary dwellings or uses.
