RESOLUTION AUTHORIZING A TEN YEAR USE AND OPERATIONS AGREEMENT WITH DULUTH COMMUNITY GARDEN PROGRAM FOR THE CITY’S DENFELD VICTORY GARDEN AND EDIBLE FOREST.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a ten year use and operations agreement, substantially in the form attached as Exhibit A, with Duluth Community Garden Program for the use and operations of the city’s Denfeld Victory Garden and Edible Forest at no cost due to improved value and public benefit provided by the Duluth Community Garden Program.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the city to enter into a ten year use and operations agreement with the Duluth Community Garden Program (DCGP) for the use and operation of the city’s Denfeld Victory Garden and Edible Forest located at Grand Avenue and 45th Avenue West. Under the terms of the agreement, DCGP will manage the use of the community garden plots, organize volunteers, and maintain the fences, raised beds, and other ornamental items.
DCGP is helping to improve the neighborhood by providing green space, gardening opportunities, community building, and other public benefits and therefore will be using this property at no cost. Construction of the garden facilities was initiated in March 2016 with oversight from the city and the DCGP.
