RESOLUTION AUTHORIZING TEMPORARY CONSTRUCTION EASEMENT AGREEMENT WITH BARRINGTON WALDORF, LLC REGARDING THE KENWOOD AND ARROWHEAD INTERSECTION.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a temporary construction easement agreement substantially in the form of that attached hereto as Exhibit A with Barrington Waldorf, LLC, a Minnesota limited liability company, granting to the city an easement to enter upon company-owned property in KENWOOD PARK ADDITION TO DULUTH, which property is more specifically described on Attachment 2 to said Exhibit A, for the purpose of constructing street and utility improvements related to the reconstruction of East Cleveland Street, and related signal improvements.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the city to enter into an agreement for temporary construction easements with the owners of the Kenwood Shopping Center (south of Arrowhead Road and east of Kenwood Avenue) related to the reconstruction of East Cleveland Street and related signal improvements in conjunction with the development of the Kenwood Village project.
