CITY PROPOSAL:
RESOLVED: that the city council approves settlement in the amount of $320,000 of all claims or causes of actions asserted against the Spirit Mountain recreation area authority and its officers and employees by Kimberly and David Meyer, individually, and as parents and natural guardians of Ryan J. Meyer, which is pending as a claim and identified as city claim number 14-016-M and further authorizes the proper city officials to execute all documents necessary to conclude this matter on a full, final and complete basis. funds payable from fund 610-036-1658-5841 (self insurance fund, insurance accounts, Spirit Mountain, liability claims expense)
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a settlement in the civil claim presented by Kimberly and David Meyer on behalf of their minor child Ryan J. Meyer. The claim arises out of an accident occurring at Spirit Mountain ski area on December 20, 2013, during which Ryan J. Meyer was injured while snowboarding. The Spirit Mountain recreation area authority was a participant in the city’s self-insurance fund at the time of the accident and is subject to a $50,000 deductible. The authority board approved the settlement at its July 28, 2016 meeting. The city administration and the city attorney recommend approval of this settlement.
