RESOLUTION AUTHORIZING APPLICATION TO AND, IF OFFERED, ACCEPTANCE OF A $385,000 PARKS AND TRAILS LEGACY GRANT TO CONTINUE THE IMPLEMENTATION OF THE HARTLEY PARK MINI-MASTER PLAN.

CITY PROPOSAL:
RESOLVED, that the city of Duluth act as a legal sponsor for the project contained in the Parks and Trails Legacy Grant request, consistent with the pre-application attached hereto as exhibit A, to be submitted on or before September 2, 2016, and that the city of Duluth is hereby authorized to apply to the greater Minnesota regional park and trail commission (GMRPTC) for funding of this project.

FURTHER RESOLVED, that the city of Duluth has the legal authority to apply for the money, and the financial, technical, and managerial capacity to ensure proper construction, operation, and maintenance of the project for no less than 20 years.

FURTHER RESOLVED, that the city of Duluth has not incurred any development costs and has no entered into a written purchase agreement to acquire the property described in the funding request.

FURTHER RESOLVED, that if the city of Duluth is awarded aforesaid grant, the city of Duluth agrees to accept the grant award and the proper city officials are authorized to enter into a grant agreement with the GMRPTC substantially in the form of the Park Legacy Grant Agreement PL14-002, attached hereto as exhibit B, agreeing to the project with grant funds to be deposited in fund 205-130-1220-4220-01 (parks fund, community resources, parks capital, state of Minnesota capital).

FURTHER RESOLVED, that the city of Duluth has or will acquire fee title or permanent easement over the land described in the funding request and therefore, as stated in the grant application for regional parks and has or will acquire fee title, perpetual easement or a minimum of a 20 year lease over the land described in the funding request and therefore, as in the grant application for regional trails.
