RESOLUTION AUTHORIZING A TEN-YEAR AGREEMENT WITH DULUTH MARKET GARDENERS AND BERRY ASSOCIATION, INC. FOR LEASE OF SPACE AT 1324 E. THIRD STREET FOR ITS FARMERS’ MARKET OPERATIONS.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to execute a ten-year agreement, substantially the same as the agreement attached as Exhibit 1, with Duluth Market Gardeners and Berry Association, Inc. for the lease of space located at 1324 E. Third Street for the purpose of operating a Farmers’ Market and other related services.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes a ten-year agreement with Duluth Market Gardeners and Berry Association, Inc., a Minnesota non-profit corporation (“Berry Association”), for the lease of space located at 1324 E. Third Street for its operation of a Farmers’ Market and other related services. 

 

The Berry Association provides opportunities for agricultural and other farm-related growers and producers from St. Louis, Carlton, and Lake Counties to sell their products to the community.  Since 1980, the Berry Association has used this location for its Farmers’ Market operation and other related services, which include providing fresh, local produce to the community, hosting educational activities, and holding festivals and other events.

 

The Berry Association shall lease the real property from City at no cost.  The consideration for the lease shall instead be the public benefit provided by the Berry Association through its Farmers’ Market operation and other related services.  Under the terms of the lease agreement, the Berry Association is responsible for all duties and costs associated with the use of the property, including maintenance and utilities.
