RESOLUTION AUTHORIZING SKYWALK AGREEMENT WITH RENDFELD LAND COMPANY PERTAINING TO THE FUR STORAGE BUILDING PROPERTY.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into an agreement substantially in the form of that attached hereto as Exhibit I with Rendfeld Land Company, a Minnesota corporation (the "Company") accepting a permanent, perpetual and exclusive easement for street and pertaining to the extension of the skywalk through the Fur Storage Building Property.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the city to enter into a Skywalk Agreement Pertaining to the Fur Storage Building Property with Rendfeld Land Company, the legal owner of the property and building which lies immediately to the east of the Lake Superior Place Building. Rendfeld Land Company is a property holding company wholly owned by Minnesota Power and Light Company.

The property in question is substantially unoccupied except for the Skywalk structure adjacent to the alley which houses the Skywalk elevator and stair tower which takes skywalk users from the second floor of the Lake Superior Place building to the third floor skywalk elevation which then takes skywalk traffic over Lake Avenue to the Tech Village Parking Ramp. The property had previously been occupied by a building in which a furrier and fur storage operation had been located but that building was acquired and torn down many years ago.

The skywalk and skywalk structure on the property was constructed under an understanding with Minnesota Power but the actual skywalk agreement had not been formalized because of issues surrounding changing requirements for the recording of agreement with the county recorder and issues of getting the required changes into the document. This resolution represents the successful completion of that process.
