CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into an assessment agreement, a copy of which is attached hereto as exhibit A, with Theresa and Darrin Severance for the installation of approximately 210 feet of water main in Maxwell Avenue to serve their property, located at 3520 Maxwell Avenue and legally described below, in the amount of not to exceed $38,875:

Lots 13 to 22, inclusive, Block 1, COMAN'S SECOND ADDITION TO DULUTH; and
FURTHER RESOLVED, that Resolution No 16-0638 is hereby amended by deleting therefrom the amount of "$20,000" and by substituting therefore the amount of "$38,875".
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize an assessment agreement with Theresa and Darrin Severance to allow the city to assess their property at 3520 Maxwell Avenue for the cost of extending a water main to serve the property and to amend the ordering in resolution to cover the costs of the project.

The Severances' had originally requested the city to extend the existing city water main to serve the subject property and indicated a willingness to be assessed for the cost thereof. The city's original estimate of cost was $20,000 and this was the amount used by the SAB when they heard and recommended the project and by the council when they ordered the project in.

Unfortunately when the project was bid, the lowest of the three bids received came in at almost double the amount of the estimate, $38,875. The Severances still wish to go forward with the project if the city continues to be willing to assess the cost against the property. Therefore, the agreement authorized by this resolution provides for the assessment of the cost of the project, up to $38,375, ...
